1. Definitions

• "Bochica" or "we" refers to the consulting practice operating under that name, based at Avenida 6N #23-61, Cali, Colombia.
• "Service" refers to the business consulting services offered by Bochica, including the Culture Listening Session, Roles & Rhythm Companion, and Organizational Study.
• "Website" refers to the website available at bochica.cyou.
• "User" or "you" refers to any person or organization accessing our website or engaging with our services.
• "Agreement" means the engagement agreement entered into between Bochica and a client organization prior to commencement of any service.
• "Content" means all written, visual, and other material produced by Bochica in the course of a service engagement.

2. Acceptance of Terms

By using this website or engaging with our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or engage our services.

These terms apply to users aged 18 and over, or organizations acting through authorized representatives with the legal capacity to enter into agreements under Colombian law.

3. Service Description

Bochica offers organizational and culture advisory services to businesses and teams located in Colombia and beyond. Services are delivered in Spanish or English and include:

• Culture Listening Session — a facilitated team conversation with written summary
• Roles & Rhythm Companion — a three-month advisory engagement with monthly sessions and ongoing support
• Organizational Study — a five-week structured assessment with interviews and a facilitated feedback session

Service availability depends on scheduling capacity. We do not accept more engagements than we can support with appropriate attention.

4. User Responsibilities

When using our website or engaging our services, you agree to:

• Provide accurate and complete information in your inquiry and any subsequent engagement
• Not use this website for any unlawful or harmful purpose
• Not attempt to access any system or data without authorization
• Respect the confidentiality of information shared in the course of a consulting engagement
• Honor payment terms agreed in writing prior to service commencement

5. Intellectual Property

All website content — including text, structure, and design — is the property of Bochica and is protected under Colombian intellectual property law. You may not reproduce or redistribute any part of the website without our written consent.

Content and documents produced specifically for a client engagement belong to the client once full payment is received. Bochica retains the right to reference the existence of the engagement (but not its contents) for professional purposes, unless the client has requested full confidentiality.

6. Payment Terms

Fees for our services are stated in Colombian Pesos (COP) and are confirmed in writing before any engagement begins. Payment terms, method, and schedule are agreed as part of the engagement agreement. Services will not commence until initial payment terms are confirmed.

Cancellation terms are agreed individually. We ask for reasonable notice of changes to scheduling and will make reasonable accommodations where possible.

7. Service-Specific Terms

For each service, specific terms covering scope, deliverables, and scheduling are agreed in writing before the engagement starts. These form part of the overall agreement and take precedence over general terms in the event of any conflict.

Changes to scope during an engagement are discussed openly and documented before any additional work is undertaken. We will not expand scope without your explicit consent.

8. Disclaimers

Our services are advisory in nature. We do not make legally binding recommendations or replace legal, financial, medical, or psychological professional advice. Any decisions made by a client organization in response to our work are the responsibility of that organization.

This website and its content are provided on an "as is" basis. We make reasonable efforts to keep information accurate but cannot guarantee that all content is current or error-free at all times.

9. Limitation of Liability

To the extent permitted by Colombian law, Bochica's liability for any claim arising from use of this website or engagement with our services is limited to the value of fees paid for the specific engagement in question. We are not liable for indirect, consequential, or incidental losses.

10. Indemnification

You agree to indemnify Bochica against any claims, costs, or damages arising from your misuse of this website or breach of these Terms and Conditions.

11. Termination

Either party may end a consulting engagement with written notice, subject to the cancellation terms in the specific engagement agreement. If you terminate early, fees for work already completed remain due. If Bochica must terminate due to unforeseen circumstances, we will make fair arrangements regarding fees and deliverables.

12. Dispute Resolution

These Terms and Conditions are governed by Colombian law. In the event of a dispute, the parties agree to first attempt resolution through direct discussion. If unresolved, disputes shall be subject to the jurisdiction of the courts of Cali, Colombia.

13. Changes to These Terms

We may update these Terms and Conditions periodically. The date at the top of this page reflects the most recent revision. Continued use of the website after changes are published constitutes acceptance of the updated terms.
